Complex Debt Recovery

Recovering large or old debts can be a challenging exercise for any individual, company or business owner. Some of the key challenges include unique contractual situations, elusive or uncontactable debtors, intricate financial or security arrangements, or simply a lack of time and resources to pursue. The situation can often seem unassailable, but with the right advice, recovery can often be achieved.

“For more complex situations, it is often only non-standard methods that will lead to successful recovery. This requires the combination of strong technical expertise with a commercial, and sometimes even creative approach.”

— Harriet Rickard, Senior Associate

If you are having trouble recovering a debt, it may be time to change your approach

Generally, different enforcement methods will exist depending on how the debt arose, and a combination of technical expertise and commerciality will be required to determine the right approach. The right advice can open up a number of non-standard avenues that can lead to successful recovery when the normal paths have failed.

Recovery can be complex

Some of the common complications when it comes to recovery include:

  1. Often the debt is linked to a unique contractual dispute which means you need to work out your contractual rights and strategy before you can move forward;

  2. If the debt has a history, often there are additional financial or security arrangements in place that need to be considered now that you want to enforce;

  3. Perhaps you can’t even contact your debtors? There are a number of avenues available that can get the attention of elusive debtors.

Why use AB?

Our clients range from sole traders and start-ups through to ASX 20 companies, and we take great care to tailor our approach to each specific situation as well as the size and circumstances of every client. Our core value proposition is that we offer top-tier expertise combined with the commerciality of a start-up, all wrapped up in our human-centered approach.

We also have a deep expertise in dispute resolution, backed up with a strong track record of extracting favourable results from difficult scenarios, and evidenced by the many complementary things our amazing clients have to say about us.

And what does a human-centered approach actually mean when it comes to disputes? More than in most areas, people issues are absolutely central to disputes management and represent an entire spectrum of factors that can have very little to do with the merits of a case. They can provide opportunities for leverage as well as unique avenues towards resolution. When managed well they can lead to exceptional outcomes that would not have seemed possible when assessing the matter on paper. Yes, we believe in this.

We also have an ingrained understanding that disputes of all kinds are usually unpleasant and highly stressful. While we can never remove those feelings entirely, we do believe that they can be mitigated through a clear strategy and honest communication.

Costs

Given the range of circumstances that can exist in any given dispute, it’s impossible to provide any concrete guidance around numbers without assessing the situation. However, we also acknowledge that for any client with a dispute, costs will be a key concern, which makes it a key concern for us.

At AB, our experience has taught us some valuable lessons around how to approach litigation costs from a strategic perspective, and you can read more about that here if interested.

We also genuinely believe that we differentiate ourselves from many competitors in this space by one simple fact - we don’t want to spend any more of your money than we have to. If at any given point we think that settlement is your best option (and it often is), that is exactly what we will tell you.

Finally, we are also open to discussing flexible pricing structures including a conditional costs model, third-party funding arrangements, or instalment-based invoicing. We are very commercial around these areas, and there are often options available that you may not have been aware of.
